Department of Journalism and Media (JaM) Tech Store Equipment Loan Terms and Conditions

1. Title

1.1 All Equipment shall remain the absolute property of Nottingham Trent University and you shall take every step necessary to ensure that the University’s rights of ownership remain fully protected.

2. Use

2.1    You will:

2.1.1     Only use the Equipment for the permitted use;

2.1.2     Operate and use the Equipment in a proper, safe, careful and skilful manner;

2.1.3     Not affect any alteration, modification or addition to the Equipment;

2.1.4     Not remove or interfere with any identification marks or plates affixed to the Equipment;

2.1.5     Undertake to comply with all instructions provided by the JaM Tech Store and technicians as to the storage, use and operation of the Equipment;

2.1.6     Comply with all laws regulations and codes of practice relating to the operation of the Equipment.

2.1.7     Not assign/transfer possession of the Equipment to any person not a party to this agreement unless you have the University’s written permission to do so.

3.     Loan Period / Late Return

3.1     Equipment will be loaned to you for a period of 48 hours only (2 working days) or as agreed.

3.2     If you require Equipment for a longer period you must first obtain permission from the JaM Tech Store team. This will not guarantee an extended loan, as there may be operational reasons for refusing. 

3.3     Equipment should be returned as soon as you have finished with it irrespective of the end of the loan period.

3.4     You shall promptly return the Equipment in good working order at the end of the loan period, or if at any time throughout the loan period, your studies are suspended or you withdraw from the course. 

3.5     If for any reason you are unable to promptly return the Equipment as specified in 3.5, you must contact the University immediately to discuss alternative arrangements.  

3.6     If you fail to return the Equipment at the end of the loan period, as specified in conditions 3.5 and 3.6, you will become liable for the Equipment.  You will be invoiced for the replacement cost of the Equipment, with the invoice being payable to the University within 30 days of its date of issue, unless the Equipment is returned as specified in 3.5, and prior to the invoice becoming payable.

4.    Maintenance

4.1     You must:

4.1.1     Take all reasonable steps to keep yourself acquainted with the state and condition of the Equipment and to keep the Equipment in good working order;

4.1.2     Notify the JaM Tech Store immediately if the Equipment fails to operate;

4.1.3     Report any damage or loss immediately to the JaM Tech Store (including a crime number if reported to the Police).

5.     Equipment Value

5.1     The Equipment available for loan may have a replacement cost of £2,000 or more.  Even small items may have a high value and should be treated with respect. A full list of replacement values can be found in the ‘JAM Tech Central’ Learning Room in NOW. 

6.     Insurance

6.1     Please be aware that University equipment on loan to students is not normally covered by your household insurance.  However, some companies may offer student insurance inclusive of University equipment on loan.  The School strongly advises that any students wishing to borrow equipment from the University should check their cover with their insurance company. 

6.2     Insurance for the Equipment against loss or damage is your responsibility throughout the duration of the agreed loan period, and whilst the Equipment is in your possession should you fail to return the Equipment at the end of the loan period.

7.     Damage or Loss

7.1     Risk of any loss or damage to the Equipment will become your responsibility upon it leaving the University’s possession and shall remain with you until the Equipment is back in the possession of the School.

7.2     The University will ensure that the Equipment is fit for purpose prior to you taking possession of it.  Any faults with the Equipment discovered upon taking possession must be reported to the University immediately, as faults discovered or reported later may be deemed to be at your risk.

7.3     If the equipment is damaged, report it to us as soon as possible.  If valuable equipment is stolen, report it to the Police and to us.  You must tell us the Police crime number for the incident. 

7.4     We will deal sympathetically with all cases of loss or damage, but we will follow up any that we suspect involve carelessness or foul play on your part.  If this is proved to be the case, you may be fined an amount up to the cost of repair or replacement.  

7.5     We expect you to act responsibly but do not put yourself in any physical danger to prevent equipment damage or loss. DO NOT leave Equipment locked in an unattended car. DO NOT keep Equipment overnight unless you need it. DO NOT unnecessarily advertise the fact that you have expensive portable equipment. DO keep equipment in your sight at all times.  

8.     General

8.1     The parties to the Agreement do not intend that any of its terms will be enforceable, by virtue of the Contracts (Rights of Third Parties) Act 1999, by any person not a party to it.  

8.2     You may not assign the benefit nor delegate the burden of the Agreement.

8.3     The Agreement shall be governed by English Law.  The English courts shall have exclusive jurisdiction to settle any disputes and the parties agree to submit to that jurisdiction.   

8.4     If the whole or any part of any provision of this Agreement is void or unenforceable in any jurisdiction, the other provisions of this Agreement, and the rest of the void or unenforceable provision, will continue in force in that jurisdiction, and the validity and enforceability of that provision in any other jurisdiction will not be affected.

SiSo Software Limited are not responsible or liable in any way for any errors, damages or any other loss caused by your usage of this system. For the avoidance of doubt this includes any loss howsoever suffered including negligence or fraud except where such negligence causes death or personal injury.
